Brazil: Law 14.222/2021 creating the National Nuclear Safety Authority (ANSN)

Brazil's Law 14.222/2021 split the National Nuclear Safety Authority (ANSN) from CNEN and gives it competence to issue licences and authorisations for site selection, construction, commissioning, operation and decommissioning of nuclear installations. Most provisions take effect with the decree approving ANSN's structure. It licenses no reactor itself.

Legal and geographic scope

Federal statute that creates the National Nuclear Safety Authority (ANSN), a federal autarchy split from the National Nuclear Energy Commission (CNEN) (art. 1), whose purpose is to monitor, regulate and inspect nuclear safety and radiological protection of nuclear activities and installations in Brazil (art. 2). Article 6, V(a) gives ANSN competence to assess safety, inspect and issue licences, authorisations, approvals and certifications for site selection and approval, construction, commissioning, operation, modification and decommissioning of nuclear installations; naval vessels with embarked nuclear plants are regulated by the Navy Command (art. 7). Articles 34 and 40 amend Law 6.189/1974, including CNEN's functions, and revoke several of its provisions. The Act entered into force on publication, but apart from changes to the licensing, control and inspection fee (from 1 January 2022) its provisions take effect when the decree approving ANSN's regimental structure enters into force (art. 41). It does not itself license any reactor.

Not approved or still pending

Establishes no licence for any project. The compiled current texts of this Act and of Law 6.189/1974 were unreachable, so later amendments are not verified; Decree 11.142/2022 (named by ANSN as approving its regimental structure) was not read, so the date the deferred provisions took effect is not recorded; ANSN regulatory norms were not reviewed.
