Romania: Law 111/1996 on the safe conduct, regulation, licensing and control of nuclear activities

Romania's Law 111/1996 makes CNCAN the authority that licenses nuclear activities, and since Law 234/2023 lists separate licensing phases for nuclear reactors: design authorisation where applicable, siting, construction and assembly, commissioning, operation and decommissioning. An environmental agreement must precede a siting licence. It approves no reactor or project.

Legal and geographic scope

Romanian framework statute on the safe conduct, regulation, licensing and control of nuclear activities for exclusively peaceful purposes. Article 1 makes the National Commission for Nuclear Activities Control (CNCAN) a specialised central public administration body subordinate to the Government. The Act covers research, design, siting, construction, commissioning, trial operation, operation, modification and decommissioning of nuclear installations (art. 2(a)), and CNCAN licenses these activities by registration certificate or licence (art. 8(1)). Article 8(8^1), introduced by Law 234/2023, sets the licensing phases for nuclear reactors: design authorisation where applicable, siting, construction and assembly, commissioning, operation and decommissioning; partial licences may be issued for these phases (art. 8(9)). Under article 37(3) the environmental agreement is a prerequisite for CNCAN's siting licence. The Act does not itself license, site or approve any reactor, design or project.

Not approved or still pending

Establishes no licence for any project or design. Amendments after August 2023 were not verified because the national legislation portal was unreachable; CNCAN's licensing norms for nuclear installations (NSN-22) and environmental-agreement procedure were not read.
