Sweden: Act on State Support for Investment in New Nuclear Power (SFS 2025:587)

Sweden's 2025 Act lets the Government grant state loans for building new nuclear power reactors and two-way contracts for difference for their operation, mainly for reactors totalling at least 300 MW of installed electrical capacity at one site, to a dedicated project company that has already applied for its nuclear and environmental licences. In force 1 August 2025; it awards support to no one by itself.

Legal and geographic scope

Swedish statute on state support to companies for investment in new nuclear power reactors in Sweden. Support may take the form of state loans for construction and trial operation and for design and other preparatory measures, and two-way contracts for difference for routine operation (ss. 2-4), on conditions set in an agreement with the state that reflects the state's risk, its ability to enforce its rights and its control needs (s. 5). The Government decides on application (s. 6). Support may be given only if the new reactors are located at the same site in Sweden and have a combined installed electrical capacity of at least 300 MW, unless the Government finds special reasons (s. 6); only to a company whose business is exclusively or almost exclusively to build, own and operate those reactors (s. 7); only together with the agreement (s. 8); only after the company has applied for the licences required under the Act on Nuclear Activities and the Environmental Code (s. 9); and only if qualified owners and management are suitable (s. 10, as amended by SFS 2026:1079). The Ordinance (2025:808) requires a written application to the Government with ownership, management and a project plan covering siting, grid connection, reactor technology options, number of reactors and electrical output. The Act does not itself grant support to any company or project.

Not approved or still pending

No support decision, loan, contract for difference or agreement under the Act was reviewed, so no company's or project's receipt of support is established. An application for support is not an award. The commencement date of the Ordinance (2025:808) and the content of the amending act SFS 2026:1079 beyond s. 10 were not checked.
