Legal and geographic scope
Current compilation of section 71-3505. Subsection (1)(g) directs collection of a fee for emergency response or environmental surveillance, or both, offsite from each nuclear power plant, equal to the cost of that work and any associated report. The fee shall not exceed the lesser of actual costs or eighty-two thousand dollars per plant per year. Beginning 1 January 2018, an inflation adjustment based on the Consumer Price Index may be recommended and shall not exceed five percent per year. The fee is credited to the Health and Human Services Cash Fund and used solely for those costs at Cooper Nuclear Station and Fort Calhoun Station. A plant that has implemented a permanent defueled emergency plan and no longer requires protective actions beyond the site boundary is not subject to the fee. Subsection (2) says that if one plant is no longer subject, the remaining plant's fee shall not exceed the lesser of actual costs or one hundred ten thousand dollars per year. The opened page prints no effective date for the section.
Not approved or still pending
The compilation prints no effective date for the section. The source line ends with Laws 2017, LB430, section 1, and that act was not opened, so 2017 is the document year of the latest cited source line only. The eighty-two-thousand-dollar and one-hundred-ten-thousand-dollar figures are statutory caps in the opened text. No inflation-adjusted amount, collected balance, or award is stored. The text does not say which plant, if either, is still subject to the fee. No project is linked. This is a state surveillance fee, not an NRC review fee and not permission to construct or operate.
Dated lifecycle
