2015 Wisconsin Act 344: repeal of the nuclear-construction conditions

2015 Wisconsin Act 344 repeals § 196.493 and removes that cross-reference from the certificate statute. The date of enactment is 1 April 2016, publication is 2 April 2016, and s. 991.11 makes it effective on 3 April 2016. Current § 1.12(4)(cm) still lists advanced nuclear energy approved by the NRC after 31 December 2010, after combustible renewables and before nonrenewable combustible resources. The repeal does not approve a plant.

Legal and geographic scope

Session law that repeals Wis. Stat. § 196.493 and strikes the words 'and s. 196.493' from § 196.491(3)(d) (intro.). It also creates § 1.12(4)(cm). The current § 1.12(4) list, opened the same day, places that item after combustible renewable resources and before nonrenewable combustible resources. The item covers a reactor design, or an amended reactor design, approved after 31 December 2010 by the U.S. Nuclear Regulatory Commission. The opened act does not restate the repealed section. Repeal of the conditions is not a certificate or a licence.

The opened act does not restate former § 196.493, and the old section URL returned HTTP 404. No certificate of public convenience and necessity is recorded. A Wisconsin location would not by itself come under this act. No governor order or commission rule was opened with it.
