Colorado Chapter 45 of 2025: nuclear energy in the clean-energy definitions

Colorado's Chapter 45, approved 31 March 2025, adds nuclear energy to the clean-energy definitions, including projects funded through a federal advanced-reactor programme. The property-tax definition does not include nuclear energy. The General Assembly bill page states an effective date of 6 August 2025, and the Secretary of State's 4 September 2026 certified statewide ballot does not include a referendum on this act. The act does not certificate a plant.

Legal and geographic scope

Session law approved 31 March 2025. It adds nuclear energy, including projects awarded funding through United States Department of Energy advanced nuclear reactor programmes, to the statutory clean-energy and clean-energy-resource definitions. For property taxation under section 39-4-101, the clean-energy-resource definition does not include nuclear energy. The session law says the act takes effect at 12:01 a.m. on the day after a 90-day period following final adjournment, unless a referendum petition is filed, in which case it takes effect only if approved at the November 2026 election. The General Assembly bill page, opened 5 October 2026, states status Became Law and an effective date of 6 August 2025. The 2025 Digest of Bills, compiled in June and July 2025, states that the General Assembly adjourned sine die on 7 May 2025, that the 90-day period expired on 5 August 2025, and that the default effective time for a bill without a safety clause was 12:01 a.m. on 6 August 2025. The Secretary of State certified 14 statewide measures for the 3 November 2026 general election on 4 September 2026. The opened list is Proposition NN, Amendments 81 through 87, and Propositions 132 through 137. It does not include a referendum on this act.

Not approved or still pending

The June and July 2025 digest was compiled before 5 August 2025, so it is not the finding that no referendum petition was filed. The effective date is the date stated on the General Assembly bill page opened 5 October 2026. The Secretary of State's 4 September 2026 certification lists 14 statewide measures and does not include this act. Local ballot measures are certified by county clerks and were not opened. The act does not certificate a plant. The property-tax definition still does not include nuclear energy. No project is linked. Governor and commission pages that returned HTTP 403 on 4 October 2026 were not retried.
