Hawaii Constitution article XI, section 8: nuclear fission plants

Hawaii's constitution requires a two-thirds vote of each legislative house before a nuclear fission power plant is constructed or radioactive material is disposed of in the state. The official text ties that section to the 7 November 1978 election.

Legal and geographic scope

Constitutional section, stored with the statute instrument type because the dataset has no separate constitution type. No nuclear fission power plant shall be constructed, and no radioactive material shall be disposed of, in the state without prior approval by a two-thirds vote in each house of the legislature. The Legislative Reference Bureau text marks it added by the 1978 constitutional convention and the election of 7 November 1978.

Not approved or still pending

The section does not itself approve a plant. HRS section 269-91 returned HTTP 403 and was not retried. A 2025 Hawaii State Energy Office report was opened and recommends no constitutional or renewable-portfolio amendment and no legislation; it is not a second instrument here. No project is linked.
