Idaho Code § 39-3027: voter submission before a law prohibiting nuclear generation

Idaho Code § 39-3027, added in 1982, says the state may not enact a law prohibiting nuclear generation of electricity unless the proposal is first put to voters. The vote is advisory. The opened section is not a reactor approval and is not limited to one class of reactor.

No Idaho law may prohibit the use of nuclear energy to generate electricity unless that proposed measure is first submitted to voters at the next earliest general election. The result is advisory and does not prevent the legislature from acting. The section is not a site certificate, a construction permit, or a limit that applies only to one reactor size.
