Idaho: SMR policy and licensing
Selected federal measures and selected state measures whose official text was opened. This is not a complete list of laws, rules or programmes for any jurisdiction. A state without a page here is not a finding that it has no policy, and these pages do not rate or prefer any state. Nothing here implies that a project is eligible for, or approved under, any measure.
Federal measures apply in Idaho as everywhere in the United States and are listed once on the federal page. They are not counted here.
Laws, rules and executive directives
- Idaho Code § 39-3027: voter submission before a law prohibiting nuclear generation · In effect
Idaho Code § 39-3027 (1982 Initiative Measure 3) · Idaho Legislature · affects: Siting
Idaho Code § 39-3027, added in 1982, says the state may not enact a law prohibiting nuclear generation of electricity unless the proposal is first put to voters. The vote is advisory. The opened section is not a reactor approval and is not limited to one class of reactor.
Not approved or pending: No vote under this section was opened. The section does not approve a reactor, name a site, or appropriate funds. Other Idaho nuclear statutes were not opened in this pass. Senate Concurrent Resolution 113 was opened as a support resolution and is not an enactment. - Idaho Executive Order 2021-02: Leadership in Nuclear Energy Commission · In effect
Idaho Executive Order No. 2021-02 (26 January 2021) · Governor of Idaho · affects: State programme administration
On 26 January 2021 Governor Brad Little signed Executive Order 2021-02 continuing the Leadership in Nuclear Energy Commission as an advisory body. The order does not approve or fund a reactor. The later 2025 task-force order does not, in its own text, rescind this one.
Not approved or pending: Executive Order 2025-06 does not say that it rescinds this order. A sentence on the 2025 press page says the later task force replaces the Leadership in Nuclear Energy Commission; that sentence is not in the 2025 order text. No commission report or appropriation was opened. No Idaho project is linked. - Idaho Executive Order 2025-06: Advanced Nuclear Energy Task Force · In effect
Idaho Executive Order No. 2025-06 (22 September 2025) · Governor of Idaho · affects: State programme administration
On 22 September 2025 Governor Brad Little signed Executive Order 2025-06 creating the Idaho Advanced Nuclear Energy Task Force. The order tells the task force to advise on nuclear policy, including small modular reactors among other technologies. It does not approve, fund, or license a reactor. The order text signs at the Capitol in Boise; the press sentence says Idaho National Laboratory.
Not approved or pending: No statute, commission order, appropriation, or reactor permission is created by this order. The press page says the task force replaces the Leadership in Nuclear Energy Commission; that sentence is not in the order text that follows it. Idaho reactor projects are not linked. The official PDF is a scan; OCR corroborates the title, number, advisory paragraphs and Boise witness clause. Executive Order 2021-02 was opened. Its text continues the Leadership in Nuclear Energy Commission and does not say that the 2025 order rescinds it.
