Policy and licensing / Puerto Rico
Puerto Rico: SMR policy and licensing
Selected federal measures and selected state and territory measures whose official text was opened. This is not a complete list of laws, rules or programmes for any jurisdiction. A state or territory without a page here is not a finding that it has no policy, and these pages do not rate or prefer any jurisdiction. Nothing here implies that a project is eligible for, or approved under, any measure.
This page covers a territory, not a state. Federal measures are listed once on the federal page and are not counted here; this page does not state how each of them applies in this jurisdiction.

Bills, proposed rules and consultations
- Puerto Rico House Bill 1092 (2026): nuclear energy and small modular reactors in the energy policy act · Proposed — not in effect
P. de la C. 1092, 20th Legislative Assembly, as passed by the House on 15 June 2026 · Puerto Rico House of Representatives · affects: Siting, State programme administration
A Puerto Rico bill would write nuclear energy and small modular reactors into the territory's energy diversification policy act, define nuclear energy as clean energy, repeal local restrictions on nuclear generation and leave licensing to federal law. It passed the House 35 to 11 on 15 June 2026 and is before the Senate. It is not law.
Not approved or pending: The bill is not law. It passed the House on 15 June 2026 and was referred to the Senate Government Committee on 19 June 2026; the legislature's tracker, read on 5 October 2026, lists no Senate vote and no action by the governor. Act 82-2010 is unchanged unless the bill is enacted. Nothing in the bill licenses, funds or sites a reactor, and no project is linked.
Funding and support programmes

What this review has read for Puerto Rico
As of 5 Oct 2026. A published record above is separate from research coverage: a class can be blocked or unreviewed even where records are published. Coverage for every state and territory.
Puerto Rico is a territory, not a state. The utility regulator checked was the Puerto Rico Energy Bureau. The federal Atomic Energy Act defines the United States, in a geographical sense, to include all territories and possessions and Puerto Rico (42 U.S.C. 2014(bb), 2021 edition read). This review did not read how federal licensing has been applied here.
- Statutes, session laws and bills: Evidence read. House Bill 1092 (P. de la C. 1092) was read as filed on 29 January 2026 and as passed by the House on 15 June 2026, with the legislature's tracker page. It would write nuclear energy and small modular reactors into Act 82-2010 and repeal local restrictions on nuclear generation. It passed the House 35 to 11 and had its first Senate reading on 19 June 2026. It is a bill, not law.
- Governor or energy instruments: Not reviewed. No governor or energy-office instrument was opened.
- Commission or siting instruments: None found in sources checked. The Puerto Rico Energy Bureau's site search for nuclear returned no results, and its integrated-resource-plan pages show no nuclear instrument. A site search covers posted pages, not the text of every order.
- Funding measures and awards: Not reviewed. No funding measure or award was opened.
