South Dakota: SMR policy and licensing
Selected federal measures and selected state measures whose official text was opened. This is not a complete list of laws, rules or programmes for any jurisdiction. A state without a page here is not a finding that it has no policy, and these pages do not rate or prefer any state. Nothing here implies that a project is eligible for, or approved under, any measure.
Federal measures apply in South Dakota as everywhere in the United States and are listed once on the federal page. They are not counted here.
Laws, rules and executive directives
- South Dakota energy facility construction permit · In effect
S.D. Codified Laws § 49-41B-4 · South Dakota Legislature · affects: Siting
South Dakota requires a Public Utilities Commission permit before a utility begins construction of a covered facility on or after 1 July 1979. The opened definition is a generation threshold of one hundred megawatts and does not say nuclear. The latest source line is 1983, with no day.
Not approved or pending: The section does not issue a permit and does not name nuclear energy. The 1 July 1979 date stays in the construction sentence. The statute-browser page was a loading shell and was not used. No adopted siting rule text was opened. No project is linked.
